These terms apply to every order you place with Tally Wholesale LLC (“we”, “us”). By placing an order, you agree to them.
Who we sell to
We sell to businesses buying for resale. Before your first order ships, we need a valid resale certificate or EIN. We may decline or cancel any order, including when we can’t verify that you are a business.
Quotes and prices
Prices are quoted in US dollars as a landed price per unit: the product, freight, customs clearance and duties to your US delivery address. A quote covers the product, quantity and specifications written on it. If any of those change, the price may change.
Quotes are valid for 14 days from the date we send them, unless the quote says otherwise. After that, freight and duty rates may have changed, so we will re-quote.
Orders and payment
- Wholesale orders are prepaid by card or ACH before they ship.
- Sourcing orders (custom or private-label products) require a 30% deposit to start production. The balance is due before the goods ship from the factory.
- Production starts only after you approve the samples in writing, where samples apply.
If you cancel a custom sourcing order before we place it with the factory, we refund your deposit minus any costs already incurred, such as samples, molds or setup. Once production has started, the deposit is non-refundable.
Delivery
Wholesale orders ship direct from the factory, and we confirm the expected delivery time in your quote. Custom sourcing usually takes about 8 to 12 weeks by ocean or 4 to 6 weeks by air, including samples and production. These are estimates, not guarantees: factory schedules, freight and customs can cause delays outside our control.
Inspection and claims
Please inspect your goods when they arrive. Report shortages, damage or defects by email with photos within 7 days of delivery. For damaged or defective goods, we will replace the affected items or credit your account. For shortages, we will ship the missing items or credit your account.
Returns
All sales are final. Goods that arrive in good condition can’t be returned; damaged or defective goods are covered under inspection and claims above. See shipping and returns.
Limitation of liability
Our total liability for any order is limited to the amount you paid for the affected goods. We are not liable for lost profits or other indirect or consequential losses.
Governing law
These terms are governed by the laws of the State of Wyoming.
